These Terms of Use govern the use of the online tool „AI Trust Audit“ („Tool“), which is provided by Trusted Shops SE, Subbelrather Str. 15c, 50823 Cologne, Germany („Trusted Shops“ or „Provider“). „User“ refers to the entrepreneur within the meaning of § 14 BGB who uses the Tool. Consumers are excluded from use.
By using the Tool, the User agrees to the validity of these Terms of Use.
1.1. The Tool performs automatic evaluations of publicly accessible data (e.g., publicly visible reviews, domain content, and structured data) and creates reports on domain trustworthiness and visibility with concrete recommendations. The results are purely informational and do not constitute a guarantee of rankings or revenue.
1.2. No access to non-public areas occurs.
2.1. The Provider makes the Tool available as a SaaS service. For the basic evaluation, entering a domain is sufficient. To receive a complete report, registration is required; the registering person confirms with registration that they are authorized to enter the data.
2.2. The Tool is provided as a beta version. Trusted Shops makes no warranty for availability, accuracy, completeness, or commercial usability of the provided data. The service is currently provided free of charge. However, Trusted Shops reserves the right to offer the Tool in whole or in part for a fee or to discontinue it in the future.
2.3. It is prohibited to use the Tool for review manipulation, circumvention of technical or organizational safeguards, unlawful data extraction, or other abusive purposes.
3.1. The User is responsible for complying with all applicable legal provisions when using the Tool, particularly in the areas of data protection, competition law, and professional or industry-specific regulations.
3.2. If the User violates applicable law, they shall indemnify Trusted Shops upon first request against all third-party claims asserted against Trusted Shops in connection with the User’s unlawful use of the Tool. Trusted Shops is entitled to take appropriate measures to defend against claims or enforce its own rights. The indemnification also includes reimbursement of legal costs.
3.3. Trusted Shops grants the User a simple, non-transferable, and non-sublicensable right to use the results specifically generated for their domain.
3.4. The User grants Trusted Shops and its affiliated companies within the meaning of § 15 AktG the non-exclusive, free, permanent, and irrevocable right to use the results generated by the Tool and the usage data for its own business purposes.
4.1. Trusted Shops is entitled to check whether the use of the Tool complies with these conditions and may restrict or block use at its own discretion if violations exist or there are indications of abusive behavior.
4.2. The User is not permitted to copy, modify, decompile the Tool or parts thereof, create derivative works, reverse engineer, disassemble, translate, or otherwise alter the source code – unless this is expressly permitted under §§ 69d, 69e UrhG.
The processing of personal data occurs in accordance with Art. 6 (1) lit. f GDPR and Art. 6 (1) lit. a GDPR. Details can be found in the applicable data protection notices.
The Tool uses algorithmic and AI-assisted procedures for evaluation. The assessments may be inaccurate, incomplete, or erroneous. The Provider observes the legal requirements applicable to it, including the relevant requirements of the EU AI Act, to the extent these are applicable.
7.1. This agreement and all disputes arising from or relating to it shall be governed exclusively by German law.
7.2. The contract language is German.
7.3. For all disputes arising from and in connection with this contract, Cologne is agreed as the place of jurisdiction, to the extent legally permissible. The same applies if the User has no general place of jurisdiction in Germany or if the domicile or habitual residence is unknown at the time of filing the action.
7.4. Trusted Shops may change these Terms of Use at any time. The User agrees that the version of the terms valid at the time of use applies, which is always published at https://business.trustedshops.de/vorteile/ai-trust-audit.
7.5. If individual provisions are or become invalid, the validity of the remaining provisions shall not be affected; the invalid provision shall be replaced by the statutory regulation.
